Summary of Strike-Everything Amendment to HB 2619
Overview
Modifies the cap on the aggregate amount of liabilities incurred by Arizona in the event a state of emergency is declared due to major disasters and how monies may be allocated.
History
The Governor may declare a state of emergency due to major disasters and incur liabilities regardless of whether the Legislature is in session. When the Governor determines that a contingency or disaster justifies and declares a state of emergency, specific liabilities and expenses are authorized to be incurred against Arizona and paid from unrestricted monies from the general fund to mitigate and meet contingencies and emergencies arising from: 1) invasions, hostile attacks, riots and insurrections; 2) epidemics of disease or plagues of insects; 3) floods or floodwaters; 4) acts of God or any major disaster; and 5) wildland fire after all outlined authorizations are exhausted (A.R.S. § 35-192).
The State Emergency Council consists of the following individuals or their designee: 1) Governor; 2) Secretary of State; 3) Attorney General; 4) Adjutant General; 5) Director of the Division of Emergency Management; 6) Director of the Arizona Department of Transportation; 7) Director of the Arizona Department of Health Services; 8) Director of the Arizona Department of Environment Quality; 9) Director of the Arizona Department of Public Safety; 10) Director of the Arizona Department of Agriculture; 11) Director of the Arizona Department of Administration; 12) Director of the Water Resources; 13) President of the Senate as an advisory member; and 14) Speaker of the House of Representatives as an advisory member (A.R.S. § 26-304).
Provisions
1. Adds a county administrator, county flood district administrator or county director of emergency management who is appointed by the Governor to the State Emergency Council. (Sec. 1)
2. Increases the cap for the aggregate amount of liabilities incurred by Arizona, from $4,000,000 to $8,000,000, when a state of emergency is declared due to major disasters, regardless of what fiscal years the monies are spent. (Sec. 2)
3. Limits to only allowing 50% of the aggregate amount of liabilities incurred in a single disaster or emergency declared due to flood or fire for reimbursement of expenses incurred by an Arizona political subdivision to mitigate damage from the flood or fire. (Sec. 2)
